These Terms and Conditions (“Terms”) govern your use of the services provided by Boykin Web Management (“we,” “us,” or “our”) and your access to boykinwebmanagement.com(the “Site”). By engaging our services or using the Site, you agree to these Terms.

Services

Boykin Web Management provides website design, website development, search engine optimization (SEO), Google Ads management, ecommerce solutions, and website maintenance services to small businesses. The specific scope, deliverables, and pricing for each engagement are agreed upon prior to the start of work.

No Long-Term Contracts

We do not require long-term contracts. You may cancel your service at any time by providing written notice via email. Your service will remain active through the end of the current billing cycle. After that period, your website or associated services may be removed or deactivated unless alternative arrangements are made.

Payments

Payment terms are outlined in your service agreement or proposal. Invoices are due upon receipt unless otherwise agreed in writing. Work will not commence or continue on projects with outstanding balances beyond the agreed payment terms.

Refund Policy

We stand behind our work. If you are not satisfied with the services provided, you are entitled to a full refund within 30 days of the initial payment. After 30 days, cancellations are permitted but refunds will not be issued for work already completed or time already invested.

Client Responsibilities

To deliver your project on time, we depend on timely feedback, content, and approvals from you. Delays caused by late responses or missing materials may affect project timelines. You are responsible for ensuring that any content, images, or materials you provide do not infringe on any third-party intellectual property rights.

Intellectual Property

Upon receipt of full payment, you own the final website design and custom code we create for you. We retain the right to display the completed work in our portfolio and marketing materials unless you request otherwise in writing. Third-party assets (fonts, stock images, plugins, themes) remain subject to their respective licenses.

Website Maintenance & Hosting

If you engage us for ongoing website maintenance or management, we will use commercially reasonable efforts to keep your site secure, updated, and operational. We are not liable for downtime caused by third-party hosting providers, domain registrars, or circumstances outside our control.

Limitation of Liability

To the fullest extent permitted by law, Boykin Web Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or the Site, including but not limited to loss of revenue, loss of data, or loss of business opportunities. Our total liability for any claim arising from our services shall not exceed the amount you paid us in the 30 days preceding the claim.

Disclaimer of Warranties

Our services are provided “as is” without warranties of any kind, express or implied. We do not guarantee specific search engine rankings, advertising results, or business outcomes. Results vary based on many factors outside our control, including market conditions, competition, and search engine algorithm changes.

Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration in the state where Boykin Web Management is registered.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
